Call to Action to Tunisian"Provisional"Government for Jasmine Sellers
Dear Provisional President,
Dear Provisional Government,
Though you don't have the
magic to solve all the problems in Tunisia during your term (supposedly one
year but you didn't even limit it), you've chosen to be decision-makers in this
country and you should accordingly assume your responsibilities...we hired you
and we pay you taxes to serve us (I said this million times but it's a good
reminder)... There are urgent actions that should be taken...there are urgent
issues that should be deeply looked up... such as the issues of children's
rights in Tunisia that have been continuously violated ...like children of the
street, beggars, workers and especially Jasmine sellers... It has become a daily scene
and has tremendousely increased since the revolution... though it is one of the worst forms of
child exploitation in Tunisia.

Provisional Government,
Immediate measures have to be
taken to investigate with the Jasmine sellers's parents for obliging their
children to work under the legal age and investigate about Bill Sikes Tunisia.
I wonder how many Oliver Twist
we have in Tunisia? and how many Sikes?
If law in Tunisia forbids all
these practices of Child labor and Child exploitation, why children's rights
are violated? Children of the street in in the world are almost 120 million and
half of them suffer in South America while 30 million live in Asia, so how many
children street we have in Tunisia dear Ministry of Women, Family and
Children's Affairs? or is it needless to count as we don't have this phenomenon
in Tunisia?
Actually, Tunisia has ratified
the international convention on children's rights in November, 29th, 1991 and
has adopted the Child Protection Code in 1995. Besides, the Labor Code in
Tunisia includes protective provisions for Tunisian children. For instance, the
Amendment 53 of the code limits the work for children to 16 years old while the
Jasmine sellers are less than 10 years old. Are these laws and conventions
implemented? or are they words on page as usual dear Provisional Government?
Children's rights violations
in Tunisia is very serious but I'm asking you to solve all these issues
now(though it is part of your duties)...This letter is specifically addressed
to the issue of Jasmine sellers... I wouldn't ask you for immediate action if I
could have done it myself (as civil society) as we help orphans, we volunteer
to teach the poor, we regularly visit children in hospitals, we offer financial
and moral support to handicapped...These are very releasable and achievable but
the issue of Jasmine sellers require the state investigation, control, research
and implementation of laws and conventions and look at their case one by
one...that of Seif, Ramzi, Ahmed,Wassim and other kids....
Let's be prompt and effective
in dealing immediately with this issue dear Provisional President and
Government, so that we can move to Juvenile delinquency and violence against
children among other issues.

عزيزي الرئيس المؤقت و وعزيزتي الحكومة المؤقتة،
مع العلم أنا هذه الفترة الإنتقالية حساسة و ليس لكم عصا سحرية لحل كل المشاكل في ظرف سنة (الفترة المؤقتة التي لم تحددوها أصلاً ) ولكن اخترتم أن تكونوا أصحاب القرار ويجب أن تتحملوا المسؤولية وتجدوا الحلول... نحن من عيناكم في مناصبكم ونحن ندفع لكم الظرائب لخدمتنا... هناك أولويات وهناك حالات مستعجلة ومسائل لايمكن السكوت عنها... و من بين هذه المسائل ، مسألة حماية حقوق الطفل المنتهكة في تونس ومنها المسكوت عنها
كاطفال الشوارع ، المتسولون والعاملون وخاصة بائعو المشموم ... وقد أصبحت ظاهرة بائعي المشموم عادية ويومية وفي إزدياد منذ الثورة... مع أنها
من أكبر ظواهر إستغلال الطفل... هناك تدابير فورية يجب القيام بها أيها الرئيس المؤقت وأيتها الحكومة التونسية المؤقتة ،
كتحقيق مع
أولياء الأطفال في أسباب تشغيلهم دون السن القانوني وتحقيق مع وليم سيكس تونس ,كم من أوليفر تويست في تونس ؟ وكم من سيكس؟ والله وحده يعلم الظروف المزرية والمعاملة السيئة والحياة المقرفة التي يعانيها أطفال الشوارع وبائعي المشموم
الذين لا يريدون التكلم خوفاً من من؟؟
بماأن "القانون" في تونكل هذا لماذا قضايا الطفل مسكوت عنها؟عدد أطفال الشوارع فالعالم يقدر بنحو 120
مليون طفل ونصفهم يوجد في أمريكا الجنوبية و-30 مليون منهم في اسيا فكم عدد أطفال الشوارع في تونس
يا وزارة شؤون المرأة و الأ سرة؟
صادقت تونس على الاتفاقية الدولية لحقوق الطفل في 29 نوفمبر من العام 1991، كما تمّ إصدار مجلة حماية الطفل بمقتضى القانون عدد 92 لسنة 1995. أما" مجلة الشغل" فإنها تتضمن أحكاما حمائية عدّة تحسب لفائدة الطفل التونسيّ كتحديد سن التشغيل وتحجير التشغيل في بعض الحالات
فأين دوريات المراقبة الأمنية ؟ أم هي قوانين فحسب وحبر على ورق كالعادة
ملف حقوق الطفل في تونس ملف كبير ولن اطالبكم الأن بحل كل القضايا (مع أنه واجبكم ) ولكن رسالتي هذه مخصصة فقط للأطفال بائعي المشموم ... لم أكن لأوجه خطابي لكم لو كان في مقدوري أن أحل هذه المشكلة بنفسي (انا=مجتمة مدني) كما نفعل في تسلية أطفال ايتام أو تدريس مجاني للفقراء أو تقديم مساعدات مادية ومعنوية لحاملي الإعاقة وزيارة للأطفال فالمستشفيات ولكن قضية بائعي المشموم رغم كل المحاولات لم يتمكن المجتمع المدني (جمعيات ، صحافة وغيرها...) من حماية الأطفال والوصول إلى مشغلهم ونظر في حالتهم حالة بحالة ، رمزي وسيف وأحمد وغيرهم ....
فالنعالج هذه المسألة معاً وسريعاً عزيزي الرئيس المؤقت و وعزيزتي الحكومة المؤقتة لنمر إلى ملف العنف الجنسي ضد الطفل في تونس , وإنحراف الطفل وغيرها ....
